Terms and Conditions

These Terms and Conditions (“Terms”) govern every order placed through the Nemesis Worx website
(the “Site”). By placing an order, you agree to these Terms. If you don’t agree to them, please
don’t place an order.

1. Who we are

Nemesis Worx (“we”, “us”, “our”) is a South African business trading as Nemesis Worx, supplying
made-to-order commercial furniture and shopfit items. [Registered company name], registration

2. Made-to-order products

Every product on the Site is built to order against the exact size, finish, branding and
add-on options you select at checkout. Nothing is held as ready-made stock. Because of this:

  • Production only starts once your order is confirmed and, where a phone confirmation call is
    part of the process for your product, once that call has taken place.
  • Lead times quoted on a product page are working days from order confirmation, not from
    payment date, and are estimates rather than guarantees — see clause 5.
  • Because each item is customised to your specification, your right to cancel or return the
    order is more limited than it would be for an off-the-shelf product. See clause 7.

3. Prices

All prices displayed on the Site are in South African Rand (ZAR) and are inclusive of VAT.
Delivery is quoted separately at checkout. We reserve the right to correct pricing errors even
after an order is placed; if a genuine pricing error affects your order, we’ll contact you before
proceeding and you may cancel for a full refund.

The price you pay is the price resolved and confirmed by our systems at checkout — not a price
computed or displayed by your browser during configuration, which is an estimate only.

4. Placing an order

Adding a configuration to your shop build and completing checkout constitutes an offer to buy,
which we accept when we confirm your order. For most products, a member of our team will phone
you within one working day of your order to check your specification against your actual space
before anything is cut or fabricated — nothing goes to the workshop before that call.

5. Lead times and delivery

Lead times shown on each product page are our best estimate, calculated in working days from
order confirmation. They are not guaranteed delivery dates. Delivery is quoted at checkout based
on your address; [Gauteng deliveries are included above R 20 000 — confirm current threshold and
any regional variations]. Risk in the goods passes to you on delivery.

6. Payment

Payment is processed through our nominated South African payment gateway at checkout. We do

7. Cancellations and returns

Because products are made to order and customised to your specification, the standard
cooling-off / return rights that apply to off-the-shelf goods under the Consumer Protection Act 68
of 2008 do not apply in the same way to custom-made items. You may cancel an order free of charge
before production has started (i.e. before the confirmation call in clause 4 has taken place).
Once production has started, cancellation may be subject to a charge reflecting materials and
labour already committed. Faulty, damaged, or incorrectly-specified (by us) items will be
repaired, replaced, or refunded in line with your rights under the Consumer Protection Act. See

8. Warranty

Products carry the warranty stated on the relevant product page (for example, a 24-month
structural warranty on carcass and base construction) against manufacturing defects under normal
use. This warranty does not cover damage from misuse, normal wear, or unauthorised modification.

9. Your information

We collect and use your personal information as described in our
Privacy Policy.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa, and you consent to the
jurisdiction of the South African courts for any dispute arising from them.

11. Changes to these Terms

We may update these Terms from time to time; the version in force is the one published on the
Site at the time you place your order.
